How a ship arrest unfolds in Egypt
Six stages, each with statutory deadlines. When documents are in order, an arrest order can be obtained the same day or the following working day.
- Step 1· Before instruction
Documents and Power of Attorney
Before any arrest application can be filed, the claimant must provide a power of attorney authorising Egyptian counsel to act, legalised and notarised in the claimant's home country, together with the original supporting documents evidencing the maritime claim. Preparation of these original documents in advance is essential. We will guide you through the legalisation process.
- Step 2· Hour 0 to 1
Initial Instruction
Secure call, conflict check and intake. We confirm jurisdiction, identify the competent Economic Court, and advise on the documents required to file.
- Step 3· 24 hours
Court Application
Sworn application drafted in Arabic with certified translations of supporting evidence, charterparty, B/Ls, invoices, statements of fact. Filed before the competent Economic Court with jurisdiction over the port.
- Step 4· Same day
Arrest Order Issued
Ex parte order granted on prima facie evidence of a maritime claim. In certain courts counter-security may be required from the claimant before the order is issued. Order served on the Port Authority, Coast Guard and master through the court bailiff.
- Step 5· Day 1+
Vessel Arrested
Departure clearance withheld. Vessel held at berth or anchorage. Negotiations open with owners, P&I club or guarantors. Substantive proceedings filed within statutory deadline to preserve the arrest.
- Step 6· On security
Vessel Released
Release on payment of security or bank guarantee, or following a successful challenge to the arrest. Court order lifted, Port Authority notified, vessel cleared to sail.
